PUBLIC PROSECUTOR The Court made the following Order: Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioners submits that the petitioners are arrayed as accused Nos.1 and 2 in Crime No.67 of 2025 on the file of Polaki Police Station, Srikakulam district, for alleged offences under Sections 467, 468, 471, 420 read with 34 of IPO. It is submitted that the petitioners and the 2”'^ respondent have a dispute over the land admeasuring Ac. 1.09 cents and in that regard, the petitioners have filed civil suits and obtained injunction from the competent civil Court. The 2'^'‘ respondent has 1 \ approached the Tahsildar of Polaki and sought for cancellation of the Pattadar Pass Books and other revenue entries made in favour of the petitioners. It submitted that the same is pending consideration before the Tahsildar. The Tahsildar has also taken note of the pending civil suits and taken any decision and left it IS as such has not open for the parties to adjudicate their disputes before the competent civil Court. Pending disposal of the civil nd suit, the 2 respondent has now alleged offences under Sections 467 with 34 of IPC against the petitioners. The learned counsel for the petitioners cannot be alleged to have committed revenue records, and the 468, 471,420 read 3. petitioners submits that the any offence in relation to any revenue authorities, after considering the documents submitted by the petitioners, have made the necessary entries in the revenue records. 4. Be that as it may, the Station House Officer, Polaki Police shall complete the investigation in Crime No.67 of 2025, without taking coercive steps against the petitioners herein. This order would Station, any not preclude the Station House Officer/Investigating Officer from filing final report/charge sheet. 5. Accordingly, the Criminal Petition is disposed of.
