BEFORE HONOURABLE MR. JUSTICE BUDI HABUNG ORDER Date : 22.07.2025 Heard Mr. A. Bodo, learned counsel for the petitioner and Ms. G. Ete, learned Additional Senior Government Advocate for the State respondents No.1 to 4. 2. By filing this writ petition under Article 226 of the Constitution of India, the petitioner has challenged the order dated 01.05.2025, issued by the Deputy Commissioner-cum-District Magistrate, East Kameng District, Seppa (respondent No.4), whereby all weekly markets in the district have been suspended with immediate effect until further orders. 3. The case of the petitioner is that by an order dated 19.02.2025, the Deputy Commissioner, East Kameng District, Seppa has granted him permission for establishment of a Weekly Market every Saturday, near Nicham Sonam Bridge subject to certain terms and conditions enumerated in the order. The petitioner claims to have complied with all such terms and conditions and has not violated any of the terms and conditions of the order dated 19.02.2025. However, by the impugned order dated 01.05.2025, the Deputy Commissioner- cum-District Magistrate, East Kameng District, Seppa (respondent No.4) has suspended the license of all weekly markets in the district with immediate effect until further orders, including that of the petitioner. 4. It is submitted that before suspending the license, no any show cause
Page No.# 3/4 notice was issued to the petitioner nor any opportunity of being heard was provided.
The grounds for suspension of the license, amongst other, are that the Superintendent of Police, East Kameng District, has registered a case against some individuals involved in gambling activities in the weekly market, despite the statutory orders, the organizers of the weekly markets have allegedly failed to adhere to the orders, as such, the authority deemed it expedient to take immediate and stringent measures to safeguard public security and maintain law and order, as well as to curb the menace of drug abuse and prohibit gambling within the district. 5. The grievance of the petitioner is that, although permission was granted by an order dated 19.02.2025 to establish a Weekly Market every Saturday, near Nicham Sonam Bridge, the same has been suspended by the impugned order dated 01.05.2025, which also affect the petitioner’s market. Being aggrieved by the suspension of the license of weekly market, the petitioner has submitted 2(two) representations dated 12.06.2025 and 25.06.2025, before the Deputy Commissioner, East Kameng District, requesting revocation of the said suspension of license of weekly market of the petitioner. However, the representations remain pending consideration. 6. At this stage, the learned counsel for the petitioner Mr. Bodo, submits that he is confining his prayer to seeking a direction to the Deputy Commissioner (respondent No.4) to dispose of the aforesaid representations within a stipulated time. 7. Ms. Ete, learned Additional Senior Government Advocate has no objection to such a direction. Page No.# 4/4

In view of the limited prayer, the writ petition is disposed of at the motion stage itself, with a direction to the Deputy Commissioner, East Kameng District, Seppa (respondent No.4) to consider and dispose of the petitioner’s pending representations dated 12.06.2025 and 25.06.2025, by passing a reasoned order, in accordance with law, within 30(thirty) days from the date of receipt of a certified copy of this order. 9.
It is made clear that this Court has not expressed any opinion on the merits of the case and the Deputy Commissioner, East Kameng District, Seppa shall decide the matter independently and on its own merits. 10. With the above, this writ petition stands disposed of. JUDGE Comparing Assistant
