Radha Maurya) arising out of case crime No. 11 of 2021, under Section 306, I.P.C., Police Station- Tharwai, District Prayagraj as well as cognizance/summoning order dated 26.8.2022, pending in the court of Chief Judicial Magistrate, Allahabad. Learned counsel for the applicant fairly admits that trial of other co-accused is pending. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/bail application/proceedings before the court of competent jurisdiction. The instant application is dismissed as not pressed with liberty to file appropriate application/bail application/proceedings before the court of competent jurisdiction.
