The present 528 BNSS application has been filed to quash chargesheet no. 31/2016 dated 20.01.2016 and cognizance/summoning order dated 08.09.2016 as well as entire proceedings in Case No. 4255 of 2016 (State Vs. Monu and others) arising out of Case Crime No. 523 of 2015, under Sections- 147, 353, 341, 379, 427 IPC and Section 3/4 Prevention of Damage to Public Property Act, Police Station- Malpura, District- Agra, pending in the Court of Additional Chief Judicial Magistrate, Court No.2, Agra. 3. Learned counsel for the applicants submits that the applicants have been falsely implicated by the police under the alleged sections. 4. In that view of the matter, they are permitted to move discharge application through counsel before the trial Court within three weeks from today and the trial court shall decide the same within a period of one month from the date of filing of application alongwith certified copy of this order. 5. Till the discharge application is decided, no coercive measures shall be taken against the applicants. 6. With the aforesaid observations, this application is disposed of.
