1. This Second anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.184/2025 registered at Police Station – Rajendra Nagar, District-Raipur (C.G.) for the offences punishable under Sections 3(5) and 318(3) of BNS, 2023. 2. The first anticipatory bail application filed by the applicant had dismissed as withdraw as the applicant could not cure the defects as pointed out by the registry by this Court in MCRCA No.1516 of 2025, vide order dated 06.10.2025.

The prosecution story, in brief is that the complainant Bhagirathi Yadav has moved a written complaint before the Police Station Rajendra Nagar, Raipur in pursuance of which the P.S. has lodged a FIR under Section 3(5) and 318(3) of BNS, 2023 that the co-accused along with the applicant has obtained a total sum of INR 1,11,25,000/- from various persons along with complainant in the name of investment in Land, Share Market stocks and Crypto currency from 03.08.2024 to 23.10.2024 and has subsequently not returned the investment or returns, therefore aforesaid offence have registered against the applicant, hence this bail application.

Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in this case. He submits that present applicant is only an employee working under the co-accused with a salary of 25,000/- per month. He also submits that applicant has never received any amount in dispute or any amount invested by the complainant or any other person in his bank account, therefore, he prays for grant of anticipatory bail to the applicant.
5. On the other hand, learned State counsel opposes the anticipatory bail application of the present applicant. He submits that applicant is a close relative of the co-accused and
3 applicant along with the co-accused has obtained a total sum of INR 1,11,25,000/- from various persons along with complainant in the name of investment in Land, Share Market stocks and Crypto currency from 03.08.2024 to 23.10.2024 and has subsequently not returned the investment or returns, therefore he is not entitled for grant of bail.
6. I have heard learned counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, the nature and gravity of the offence, submissions made by learned counsel for the parties and the material available on record in the case diary, it appears that the applicant is involved in the crime in question, Therefore, I am not inclined to grant anticipatory bail to the applicant, further there appears to be no new ground.

Accordingly, the Second anticipatory bail application of the applicant– Abhishek Praveen Joseph filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.184/2025 registered at Police Station – Rajendra Nagar, District-Raipur (C.G.) for the offences punishable under Sections 3(5) and 318(3) of BNS, 2023, is rejected.
9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
