The present petition has been filed with the following prayer:- a. Permit the petitioner to submit an undertaking before this Hon’ble Court or before the respondents to the effect that he shall serve the remaining period of his service bond upon completion of his PG course; b. Issue an appropriate writ, order, or direction, directing the respondents No. 4 & 6 to consider the undertaking submitted by the petitioner and thereafter to issue the No Objection Certificate [NOC] and grant a permanent registration number in favour of the petitioner, thereby enabling him to participate in the NEET-PG 2025 counselling process; c. Grant the cost of the petition to the petitioner. d. Grant any other relief as deemed fit and proper in the facts and circumstances of the case. 4 2. According to the petitioner on successful completion of MBBS Degree from respondent No. 7 college in the month of March 2023, the petitioner undergone the internship as per the rules and thereafter he has been posted as Junior Resident at District Hospital Sukma on 03.08.2024. The said posting of the petitioner is pursuant to the bond submitted by him as per the rules namely; the Chhattisgarh Chikitsa, Dant Chikitsa Evam Bhoutik Chikitsa (Physiotherapy) Snatak Pravesh Niyam, 2018 (hereinafter for the sake of brevity referred to as ‘The Rules 2018’). Pursuant to the said posting order, the petitioner joined his service on 30.09.2024 and discharging his duties with utmost sincerity and honesty. In the meantime the petitioner appeared in the post graduate examination conducted by the National Board of Examinations, Medical Sciences (NEET-PG). In the said examination the petitioner obtained 511 marks out of 800 marks and All India Rank of petitioner is 21511, as such he qualified in the said examination. Now the petitioner wants to take admission in P.G. Course for which the petitioner moved a representation before the respondent authorities on 27.09.2025 and requested for issuance of NOC, so as to enable him to participate in the PG counselling process. In the said 5 representation the petitioner contended that on completion of P.G. course he will come and join the post of Junior Resident and will complete remaining period of tenure. Despite the said fact the respondent authorities are not issuing the requisite NOC to the petitioner, which is a necessary document at the time of taking admission in P.G. Course. If the same is not issued the future career of the petitioner will be ruined. Thus, this petition. 3. On the other hand learned counsel for the State would oppose the aforesaid submission and would submit that as per the Rules 2018, the petitioner is required to complete the bond posting as per Rule 10 of the Rules 2018. 4. We have heard learned counsel for the parties and perused the documents with utmost circumspection. 5. It is not in dispute that the petitioner completed the MBBS course from the respondent No. 7 college and also completed the internship of one year. Subsequently as per the posting order issued by the respondent authorities, the petitioner joined at District Hospital Sukma. Thereafter, he qualified in the NEET-PG examination and secured the All India Rank of 21511. 6 6. it is noteworthy to mention here that Rule 10 of the Rules 2018 speaks about bond with regard to rendering the service under the Government on completion of MBBS Course, which reads thus:- “10. (अ) राज्य शासन के अधीन स वा केरान हे तु एम.बी.बी.एस. पाठ्यक्रम म प्रवा शा ले न वाले अभ्यर्थी हे तु बीधीपात्र (बीण्ड) (1) शासके"य चि$किकेत्स महेकिवाद्यालेय( के एम.बी.बी.एस. पाठ्यक्रम म प्रवा शा ले न वाले छात्र के चिलेए अकिनवाय* हे+गा, किके स्नतुके पाठ्यक्रम सफलेतुपा/वा*के पा/र्ण* केरान के बीद, शासन द्वारा अधिधीस/चि$तु किकेए गाए ग्रामर्ण क्षे त्र( म द+ वार्षों7 के" केलेवाधिधी तुके चि$किकेत्स अधिधीकेरा के रूपा म शासके"य स्वास्थ्य के न्द्र अर्थीवा शासके"य चि$किकेत्स महेकिवाद्यालेय म जू/किनयरा राजिजूस्ट्रारा / प्रदशा*के / जू/किनयरा रा चिसडट के रूपा म केय* केरा गा। अन्य पाठ्यक्रम( (बी.ड.एस., किफजिजूय+र्थी रा पा बी.पा.टA.) हे तु यहे अकिनवाय*तु नहेB हे+गा। (2) शासन के अधीन केय* केरान के चिलेए बीधीपात्र (बीण्ड) ( प्ररूपा अनस/$ पा$) – प्रवा शा के समय अभ्यर्थी के+ किनधी*रिरातु प्रपात्र म यहे बीधीपात्र प्रस्तुतु केरान हे+गा, किके वा किनयम 10 (1) के प्रवाधीन( स सहेमतु हेD औरा यदिद वा शासन के अधीन केय* न केरान के किवाकेल्पा के $यन केरातु हेD, तु+ वा किनयम 10 (3) म यर्थी किनधी*रिरातु बीधीपात्र राचिशा के+ जूम केरागा । उसके द्वारा सम्पू/र्ण* द य राचिशा के जूम हे+न के बीद हे अभ्यर्थी के+ यर्थी किनधी*रिरातु अनपात्तिK प्रमर्ण पात्र जूरा किकेय जूएगा। ( 3) बीधीपात्र (बीण्ड) – के" राचिशा अनरात्तिक्षेतु श्रे र्ण के अभ्यर्थी के चिलेए बीधीपात्र (बीण्ड) के" राचिशा रूपाय 25,00,000/- (रू. पाच्चीस लेख मत्र) एवा 7 आरात्तिक्षेतु श्रे र्ण के छात्र के चिलेए बीधीपात्र (बीण्ड) के" राचिशा रूपाय 20,00,000/- (रू. बीस लेख मत्र) हे+गा। (4) इन किनयम( के तुहेतुQ एम.बी.बी.एस. पाठ्यक्रम म प्रवा शा ले $के अभ्यर्थिर्थीSय( के+ पाठ्यक्रम के सफलेतुपा/वा*के पा/रा केरान के बीद आराभ म अस्थाय (अनकितुम) स्नातक किडग्रा प्रदन के" जूएगा। आराभ म स्नतुके य+ग्यतु के के वाले अस्थाय (अनकितुम) पाजूयन राज्य चि$किकेत्स पारिरार्षोंदQ द्वारा राज्य म किडकेले पाजू (राजिजूस्टरा) म किकेय जूएगा। (5) अकितुम वार्षों* के पारिरार्णम के" घो+र्षोंर्ण के एके महे के भतुरा स्नतुके पाठ्यक्रम के+ सफलेतुपा/वा*के पा/र्ण* केरान वाले सभ अभ्यर्थिर्थीSय( के" स/$ आयक्तु के+ सबीधिधीतु चि$किकेत्स महेकिवाद्यालेय द्वारा प्र किर्षोंतु के" जूएगा। (6) एम.बी.बी.एस. पाठ्यक्रम पा/र्ण* केरान के पाश्चातुQ छाZ महे के" केलेवाधिधी के भतुरा आयक्तु, स्वास्थ्य एवा पारिरावारा केल्यर्ण ऐस स्नतुके डक्टरा( के+ किनयक्तिक्तु आद शा जूरा केरागा , ऐस न केरान के" क्तिस्थाकितु म अभ्यर्थी द्वारा भरा गाय बीण्ड स्वाम वा किनरास्तु समझा जूएगा। (7) किनयम 10 (1) के अनसरा स वा अवाधिधी शातु* पा/रा केरान के बीद अर्थीवा किनयम 10 (3) के अनसरा समस्तु द य राचिशा जूम केरा दिदए जून के बीद अर्थीवा अभ्यर्थी स उक्तु शा र्षों अवाधिधी के" बी^के गाराण्टA ले न के बीद, जूDस भ क्तिस्थाकितु हे+ ( अभ्यर्थी द्वारा चिलेए गाए किवाकेल्पा पारा किनभ*रा) आयक्तु अभ्यर्थी के+ अनपात्तिK प्रमर्ण पात्र जूरा केरा गा। (8) तुत्पाश्चातुQ अभ्यर्थी अपान महेकिवाद्यालेय के अधिधीष्ठातु के+ उक्तु अनपात्तिK प्रमर्ण पात्र प्रस्तुतु केरागा , जिजूनके" अनशास पारा किवाश्वकिवाद्यालेय द्वारा अकितुम किडग्रा प्रदन के" जूएगा। 8 (9) राज्य म किडकेले केउचिसले राजिजूस्टरा (पाजूयन) म स्नातक य+ग्यतु के स्थाय पाजूयन अभ्यर्थी के+ प्रदय अकितुम किडग्रा के आधीरा पारा हे किकेय जूएगा। (10) किनयम 10 (1) के अनपालेन नहेB केरान के चिलेए दण्ड यदिद के+ई अभ्यर्थी शासन के अधीन स वा केरान के $यन केरातु हेD औरा किनयम 10 (1) के अनपालेन न केरान के द+र्षों पाय जूतु हेD, तु+ किनयम 10 (3) म यर्थी उक्तिल्लेखिखतु बीण्ड के" सम्पू/र्ण* राचिशा के" वास/ले अभ्यर्थी स भ/- राजूस्वा के बीकेय के रूपा म उपारा+क्तु उपाकिनयम (6) के अनसरा किनयक्तिक्तुकेतु* केय*लेय द्वारा केय*वाहे के" जूय गा। ऐस अभ्यर्थी के+ किनयम 10 (7) म यर्थी उक्तिल्लेखिखतु अनपात्तिK प्रमर्ण पात्र तुबी तुके प्रदन नहेB किकेए जूएगा, जूबी तुके किके सम्पू/र्ण* द य राचिशा के" वास/ले नहेB हे+ जूतु। (बी) राज्य शासन के अधीन शासके"य/ किनजू बीडएस पाठ्यक्रम म प्रवा शा ले न वाले अभ्यर्थिर्थीSय( हे तु बीधीपात्र (बीण्ड) - छाKसगाढ़ राज्य के दतु चि$किकेत्स महेकिवाद्यालेय / किनजू दतु चि$किकेत्स महेकिवाद्यालेय म प्रवा शा हे तु किनयमनसरा बीडएस के अनरात्तिक्षेतु श्रे र्ण के अभ्यर्थी हे तु रु. 5 लेख तुर्थी आरात्तिक्षेतु श्रे र्ण के अभ्यर्थी हे तु रू. 3 लेख के बीधीपात्र (बीण्ड) किनष्पादिदतु केरान हे+गा, जू+ किके किनधी*रिरातु प्रवा शा के" कितुचिर्थी उपारान्तु पाठ्यक्रम के मध्य म सट के पारिरात्यगा केरान के" क्तिस्थाकितु म उपारा+क्तु बीधीपात्र (बीण्ड) के" राचिशा द य हे+गा। 7. From bare perusal of the aforesaid provision, it is apparent that Rule 10(vii) provides that after fulfilling the service period condition as per rule 10 (i) or after all dues have been 9 deposited as per rule 10(iii) or after obtaining a bank guarantee from the candidate for the balance period, as the case may be (depending on the option exercised by the candidate), the Commissioner shall issue a No Objection Certificate to the candidate. 8. Rule 5 of the Rules namely Chhattisgarh Chikitsa Snatkottar Pravesh Niyam 2021 speaks about ineligibility in the admission of P.G. course, the same reads thus:- 5. प्रवेश हेतु अपा त्रतु :- (एके) ऐस अभ्यर्थी, जिजून्हे(न पा/वा* म अखिखले भरातुय / राज्य के+ट स प्रवा शा उपारान्तु सट के पारिरात्यगा किकेय हे+ य अभ्यर्थी के+ किनष्केचिसतु किकेय गाय हे+ तु+, ऐस अभ्यर्थी पारिरात्यगा / किनष्केसन के" कितुचिर्थी स किडग्रा हे तु आगाम 03 वार्षों* तुके तुर्थी किडप्ले+म हे तु आगाम 02 वार्षों* तुके स्नातकत्तर पाठ्यक्रम म प्रवा शा हे तु अपात्र हे(गा । (द+) ऐस अभ्यर्थी, जिजून्हे(न स्नातकत्तर किडग्रा / किडप्ले+म पाठ्यक्रम पा/र्ण* केरा चिलेय हेD, उन्हे उनके द्वारा पा/र्ण* किकेय गाय पाठ्यक्रम के पाश्चातुQ पाठयक्रम पा/र्ण* केरान के" दिदनके स किडग्रा हेतु आगाम 03 वार्षों* तुके तुर्थी किडप्ले+म हे तु आगाम 02 वार्षों* तुके स्नातकत्तर पाठ्यक्रम म प्रवा शा हे तु अपात्र हे(गा । (तुन) ऐस अभ्यर्थी, जिजून्हे(न अखिखले भरातुय के+ट स राज्य के स्नतुके+Kरा पाठयक्रम म प्रवा शा चिलेय हेD, वा राज्य के+ट के" सट( हे तु अपात्र हे(गा । 10 ($रा) छाKसगाढ़ राज्य अतुगा*तु एम.बी.बी.एस. पाठ्यक्रम पा/र्ण* केरान के पाश्चातु अकिनवाय* शासके"य स वा हे तु किनष्पादिदतु बीधीपात्र म उल्ले खिखतु अवाधिधी पा/र्ण* हे+न के छाKसगाढ शासन के ले+के स्वास्थ्य एवा पारिरावारा केल्यर्ण किवाभगा के आयक्तु के अनपात्तिK प्रमर्ण पात्र प्रस्तुतु नहेB केरान वाले अभ्यर्थी स्नातकत्तर पाठयक्रम म प्रवा शा हे तु अपात्र हे(गा । 9. From the aforesaid Rule 5(iv), it appears that if the candidate failed to submit the requisite NOC, he will not be able to get the admission in P.G. Course and will be declared as an ineligible candidate. 10. In the case at hand, the petitioner, is seeking a direction towards the respondent nos. 4 and 6 to consider the undertaking submitted by him and to issue requisite NOC in his favour by permitting to participate in the P.G. counseling process. The petitioner undertakes to serve the remaining period of his bond service upon completion of P.G. course. From perusal of the Rule 10 (vii) of the Rules 2018, it is evident that there is no such power to relax the bond service period on the basis of an undertaking given by the candidate. In fact, Rule 10(vii) provides that after fulfilling the service period condition as per rule 10 (i) or after all dues have been deposited as per rule 10(iii) or after obtaining a bank 11 guarantee from the candidate for the balance period, as the case may be (depending on the option exercised by the candidate), the Commissioner shall issue a No Objection Certificate to the candidate. In the present case, the petitioner is seeking relaxation of such condition by replacing the condition by an undertaking submitted by him. As the Rules 10 of the Rules 2018 is a mandatory provision, unless and until the petitioner fulfill the said condition, the relaxation as sought by the petitioner cannot be granted. 11.In view of forgoing, we are not in a position to entertain this petition at this juncture, accordingly, the petition is dismissed at the motion stage itself.
