This is First anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.66/2025 registered at Police Station – Saliha, District – Sarangarh-Bilaigarh (C.G.) for the offence punishable under Sections 191(2), 221, 296, 132, 121(1), 329, 331(5) and 352 of BNS. 2. 2 who have not taken any strict action on the complaint made by the villagers of villages situated under the area of the Saliha Police Station. That, the people of the locality have made many complain with regard to illegal activities like gambling, illegal sale of liquor and cattle smuggling have been going on continuously in the area of Saliha police station for a long time. Information about all this has been given to the police administration earlier also, but no concrete and effective action has been taken by the Police of Police Station Saliha. Due to these illegal activities, crime is increasing in the society, the young generation is falling prey to drug addiction and the law and order situation is continuously deteriorating.
That, ue to non action of the complaint made by the people of the locality, so on call of the said Deepak Tandan, they appeared in front of the police station and were protesting peacefuly, then the police started pushing them with the help of sticks to escape, at the same time there was a minor scuffle between the protesters and the police, no one was hurt, due to the said incident, but the police of Police Station Saliha has registered the FIR against the protesters and the present applicants for the offence punishable Under Section 191(2), 21, 296, 132, 121(1), 329, 331(5) and 352 of BNS and the police sought to arrest the applicants in the alleged commission of offence. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is submitted that co-accused persons have already been granted anticipatory bail by this Court in MCRCA No.1449/2025, MCRCA No.1526/2025 vide order dated 18.09.2025 and 07.10.2025. a copy of the same are annexed herewith as Annexure – A/2. Therefore, he prays for grant of anticipatory bail to the applicant. 3
4. On the other hand, learned State counsel opposes the bail application of the applicant. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and considering the fact that co-accused persons have already been granted anticipatory bail by this Court in MCRCA No.1449/2025, MCRCA No.1526/2025 vide order dated 18.09.2025 and 07.10.2025, therefore this Court is of the view that the applicant is entitled to be granted anticipatory bail in this case on the ground of parity. 7.
Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Surendra Kumar Dadsena on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which
