The Court made the following Judgment: (per Hon’ble Sri Justice R. Raghunandan Rao)
The 1st respondent herein, had approached this Court, by way of W.P.No.7729 of 2025, contending that, the respondents 2 to 4 herein, at the behest of the appellant herein were seeking to dispossess her from an extent of Ac. 3.00 cents in Sy.No.1641/6 and an extent of Ac.1.30 cents in Sy.No.1641/8 of Munnelli Revenue Village, B. Kodur Mandal, Y.S.R. Kadapa District and that, such actions are illegal and arbitrary. 2. When the matter came up before a learned Single Judge of this Court, the learned Assistant Government Pleader, had stated that the respondents 2 to 4 would act strictly in accordance with law and any dispossession of the 1st respondent would be done by following the procedure established under law. The learned Single Judge, recording this statement, disposed of the Writ Petition, on 25.03.2025, directing the respondents, not to interfere with the 1st respondent’s peaceful possession and enjoyment of the property, except by following due process of law, if the appellant is in possession. 3. The appellant, who is arrayed as the 4th respondent in the Writ Petition, has approached this Court, with the complaint that, the Order is being misused and that, the 1st respondent, under the guise of the said Order is trying to dispossess the appellant, who is in actual possession. It is further submitted that, a Civil Suit has already filed bearing O.S.No.85 of 2025 on the file of the learned Junior Civil Judge, Badvel. 4 RRR,J & TCDS,J W.A.No.1029 of 2025
4. Heard Sri D. Vigneshwar, learned counsel appearing on behalf of Sri V. R. Reddy Kovvuri, learned counsel for the appellant, Sri L. J. Veera Reddy, learned counsel appearing for the 1st respondent and the learned Assistant Government Pleader for Revenue appearing for the respondents 2 to 4. 5. The Order of the learned Single Judge, is quite clear and directed the official respondents 2 to 4 not to interfere in the possession of the land by the 1st respondent except in accordance with law provided, if the 1st respondent is in possession. The learned Single Judge, had not given any finding relating to possession of either party. 6.
However, in view of the reservations expressed by the appellant herein, the said Order of the learned Single Judge stands modified to the extent of the said Order being applicable to the respondents 2 to 4 herein. The said order would not be applicable to the appellant herein. However, the question of who is in possession of the land is not being determined by this Court in any manner and the learned Junior Civil Judge, Badvel, shall go into the question raised before her in O.S.No.85 of 2025 without preference to any of the observations either by the learned Single Judge or by this Court. 7.
