PUBLIC PROSECUTOR (AP) The Court made the following; ORDER: The instant petition under Section 482 of the Code of Criminal Procedure, 1973 has been filed by the Petitioner/Accused seeking quashment of the F.I.R. in Crime No.51 of 2022 of Nadendia Police Station, Guntur District, registered for the offences punishable under Sections 3(1) (r). 2 9 3(1) (s) and 3(2) (va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short “S.C. and S.T. Act”). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor on behalf of the State. 3. Learned counsel for the petitioner would submit that it is a counter case to Crime No.49 of 2022 which is lodged against one Gunti Vijaya Bhaskara Reddy and others.. Learned counsel would further submit that by using the name of the de facto complainant, who belongs to scheduled caste, a false case has been lodged against him. 4. Learned Assistant Public Prosecutor would submit that this petition is filed at F.I.R. stage and the petitioner has obtained interim stay of all further proceedings in this matter. Learned Assistant Public Prosecutor would further submit that the matter may be disposed of, giving liberty to the police to complete the investigation by giving protection to the petitioner. 5. Considering the submissions made, this Criminal Petition is disposed of as the offences under Sections 3(1 )(r), 3(1) (s) and 3(2) (va) of S.C. and S.T. Act, are punishable with less than seven years period of imprisonment, the police are directed to conclude the investigation and file report, according to 3 law. The police are also directed to strictly adhere to the guidelines issued by the Hon’ble Supreme Court in Arnesh Kumar v.
