Petitioners, 35 in all, espousing a joint and common cause, claiming to be ITI trained Matriculates and working as Technician-III with the respondent- Jammu Power Development Corporation under the administrative control of Power Development Department of J&K Government, through the medium of this joint petition, seek direction upon the respondents to upgrade their pay scale on the analogy of the pay scales so extended to the similarly situated ITI Matriculates of Technical Education Department more particularly working on the designation of Foreman/Surveyor/Supervisor as provided under Schedule-II(C) appended to SRO 145 of 2002 dated 10.04.2002, having qualification of Matric with ITI. 02. Petitioners have pleaded that they have been working in the pay scale of Rs. 3050-4590, whereas, their counter parts in Technical Education Department have been placed in pay scale of Rs. 6500-10500 (pre- revised) and Rs. 9300-34800 (revised) that having the same qualification Serial No.93 2 in view of the “Equal Pay for Equal Work” principle, they are entitled to the equivalent pay scales. 03. Learned counsel for the petitioners submits that the petitioners shall be satisfied, in case their petition is disposed of at this stage, with a direction to the respondents to consider their case in the light of Principle of “Equal Pay for Equal Work” which has already been ordered to be adhered to, in judgments dated 20.07.2016 passed in SWP No. 1911/2013, titled, “Anil Raina & Ors. Vs. State of J&K & Ors”, upheld in CDLSW No. 74/2018, titled, “State of J&K & Ors Vs. Anil Raina & Ors.” vide judgment dated 11.11.2022 which attained finality after dismissal of SLP(C) No. 6172/2023 titled, “State of J&K & Ors Vs. Anil Raina & Ors”, by the Apex Court vide judgment dated 13.04.2023, on the point of limitation. 04. In view of the pleadings and submissions made by the learned counsel for the petitioners, this petition is disposed of at the motion stage, without commenting on the merits of the case, with a direction to the respondents to consider the plea raised by the petitioners in this petition under the principle of “Equal Pay for Equal work” as enunciated in the aforementioned judgment, if applicable, in accordance with law. 05.
