This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.78/2025 registered at Police Station Gourella, District - Gorella- GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.11.17 11:09:09 +0530
2 Marwahi-Pendra (C.G) for the offence punishable under Sections 21, 22(c) of NDPS Act. 2. Case of the prosecution, in brief, is that on 26.03.2025, acting on secret information, Police Station Gourella conducted a raid near Purana Gourella under-bridge and apprehended accused Atul Sahu, Manish Masih, and Laxman Sarathi. From their possession, 20 ampoules of Buprenorphine Injection and 20 vials of Avil Injection along with cash and a motorcycle were seized under the NDPS Act. During investigation, on the basis of memorandum of co-accused Atul Sahu, it was alleged that accused Salman Khan had supplied the narcotic injections in consideration of Rs.20,000. From Salman, a mobile phone worth Rs.6,000 and cash of Rs.1,200 were seized, which the police alleged were linked to the illegal trade. Thereafter, the applicant/accused Salman Khan was arrested on 27.03.2025 in connection with Crime No.78/2025 registered at P.S. Gourella. 3. It is submitted by learned counsel for the applicant that no recovery of any contraband article has been made from his possession and only on the memorandum of the co-accused from whom commercial quantity of contraband injection was recovered, he has stated that the contraband injection was sold by the applicant. She would submit that charge sheet has been filed, applicant is in jail since 27/03/2025 and conclusion of the trial may take quite long time, therefore she prays for enlarging the applicant on regular bail. 4. Learned counsel appearing for the State/respondent would oppose the bail application and submit that the charge-sheet has been filed in the present case before the competent Court.
He would submit that the
3 contraband article which has been recovered from the co-accused person is above the commercial quantity and the applicant has sold the said contraband injection to the said co-accused person, as such, it is an organized crime, therefore the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, nature of allegation levelled against the applicant, further the fact that the contraband article which has been recovered from the co-accused person is above the commercial quantity and the fact that the applicant has sold the said contraband injection to the said co-accused person, as such, it is an organized crime, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant Salman Khan, involved in Crime No.78/2025 registered at Police Station Gourella, District - Gorella- Marwahi-Pendra (C.G) for the offence punishable under Sections 21, 22(c) of NDPS Act, is rejected. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information. - Sd/-- Sd/-
