This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.119/2025 registered at Police Station Baikunthpur, Distt.- Koriya (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5) & 111 of BNS. 2. Case of the prosecution, in brief, that various victim had lodged their complaints online on the on the basis of the letter received by the Additional Superintendent of Police from the office of Inspector General of Police SIV/CCTNS/Cyber Crime Police Headquarters Nava Raipur VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.11.24 11:04:41 +0530 2 C.G. to take legal action the listed account holders of the mule account of Bank of Maharashtra branch Baikunthpur whose accounts have been used for cyber fraud. As mentioned in the statement of Bank of Maharashtra, the bank account of co-account of co-account of co- accused Satyam was opened on 05.02.2024. After opening the account of co-accused Rajkumar and Rs.3,06,833/- was debited. Similarly, a total of Rs.17,67,013/- was credited to the bank account of accused Satyam Kumar and Rs.17,61,771/- was debited. A case number 119/2025 has been registered against a total of 14 persons by Baikunthpur Police Station for the aforesaid offences. 3. Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in this case and the applicant has no role in the alleged offence. He would submit that the applicant has no connection with any organized or cyber-criminal activity. He would submit that bail applications of the co-accused persons namely Rajkumar and Paremeshwar Kurre and Akshay Kumar Sonwani were rejected by this Court vide order dated 03.09.2025 and 11.07.2025 in MCRC No.7032 of 2025, MCRC Nos. 4138 of 2025 and 4154 of 2025 respectively. He would submit that charge sheet has been filed, the applicant is in jail since 16/06/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and he would submit that charge sheet has been filed in this case before the competent court. He would further submit that applicant has only one criminal antecedent bearing crime No.150 of 2025 registered at police station of Surajpur. He also submits that in compliance of the Court’s order dated 06/10/2025, the Superintendent of Police has filed his personal affidavit. He further submits that co- 3 accused persons namely Rajkumar, Paremeshwar Kurre and Akshay Kumar Sonwani were rejected by this Court vide order dated 03.09.2025 and 11.07.2025 in MCRC No.7032 of 2025, MCRC Nos. 4138 of 2025 and 4154 of 2025 respectively. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the fact that the bail application of the co-accused persons namely Rajkumar, Paremeshwar Kurre and Akshay Kumar Sonwani were rejected by this Court vide order dated 03.09.2025 and 11.07.2025 in MCRC No.7032 of 2025, MCRC Nos. 4138 of 2025 and 4154 of 2025 respectively, further considering the fact that the applicant along with co-accused persons knowing provided their bank account to cyber fraudsters for carrying out illegal financial transactions hence, this Court does not find it to be a fit case to release the applicant on regular bail. 7. Accordingly, the bail application of applicant Sourabh Sahu, involved in Crime No.2119/2025 registered at Police Station Baikunthpur, Distt.- Koriya (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5) & 111 of BNS, is rejected. 8.
