This intra-Court appeal is directed against the judgment and order dated 08.05.2018, passed by learned Single Judge in WPSS No. 1872 of 2013. By the said judgment, writ petition filed by respondent was allowed and authorities were directed to include his name in the seniority list by taking into consideration his services rendered with effect from 12.09.1997 and also to consider his case for regularisation, within ten weeks. 3. Appellant has challenged the said judgment on the ground that there is a finding recorded by Coordinate Bench that in 1997, when respondent was allegedly appointed as daily wager, he was only 12 years of age, as his date of birth is recorded 15.04.1985. Thus it is contended by learned counsel for the appellant that the impugned judgment is unsustainable whereby direction was issued to the authorities to take into account the services rendered by 2025:UHC:4848-DB respondent since 12.09.1997, when he was only 12 years of age. 4. Since learned Single Judge has only directed the authorities of Govind Ballabh Pant University of Agriculture and Technology, Pantnagar to consider case of the respondent for regularisation, therefore we do not find any reason to interfere in the matter. However, we make it clear that the services rendered by respondent after the date he attained majority, as per the date of birth indicated in the judgment rendered by learned Single Judge in WPSS No. 668 of 2014 i.e. 15.04.1985 alone shall be taken into account for seniority amongst daily wagers/casual employees. 5. With the aforesaid observation, Special Appeal is disposed of. 6. The exercise shall be completed by Regularisation Committee as per the applicable rules within four months from date of production of certified copy of this order. (Subhash Upadhyay, J.)
