Also heard Ms. Yasmin Gao, learned counsel, appearing on behalf of Mr. Marto Kato, learned DSGI. Mr. Mow, learned counsel for the petitioner, on being queried by this Court as to whether this writ petition would be maintainable in view of the fact that the recruitment in the instant writ petition as sought to be made, is against a post in the Geological Survey of India, on compassionate ground and the same being maintainable before the jurisdictional Central Administrative Tribunal, as a Court of first instance; has submitted that he may be permitted to withdraw the present writ petition with liberty to the petitioner to approach the appropriate forum for redressal of his grievances.
