DASARI RAMAKOTESWAR RAO Counsel for the Respondent/complainant: 1.PUBLIC PROSECUTOR The Court made the following= ORDER:- This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A2, seeking regular bail, in Crime No.79 of 2024 of Mothugudem Police Station, AIIuri Seetha®,lama Raju District. 2. A case has been registered against the petitioner herein and others for the offence punishable under Section 111(2) (b) of the Bharatiya Nyaya Sanhita (for short lthe BNS') and Section 8(c) r/w eeLd#rc4 20(b)(ji)(c) of the NarcotI'5' Drugs and psychotropic substances Act, 1985 (for short lthe NDPS Act'). 3. Case of the prosecutioM-n brief, is that, on 25.10.2024, on receI-Pt of credible information, the sub-Inspector of police along with his staff and mediators conducting vehl'cle checkl'ng at opposl'te to Mothugudem police Station and found accused in possessI'On Of 20 Kgs of GanJ-a. The contraband along with other materl'al was seized under the cover of mediators report. 4. Heard. perusedtherecord. 5. On perusal of the materl'al on record goes to show that basing on the confessI-Onal statements of co-accused, name of the petitioner herein/A2 I'S arrayed as accused I-n the present crI'me. In pursuant to the confessional statement, the petI'tjOner herein was arrested on 26.ll.2024. Except the confessional statement, there I'S nO Other material is collected showI'ng the complicl'ty of the petI-tI-Oner in the present crime. The quantity of contraband allegedly seized from the possession of the accused is 20 Kgs of ganja. Learned Assistant public prosecutor submitted that major portion of investigation has been completed and the charge sheet could not be filed for want of inventory and there are no antecedents against the petitioner herein. <fsss:ss-± I 3 6, ln view of the aforesaid facts and circumstances Of the Case, this court is inclined to grant bail to the Petitioner/A2 on the following conditions. i) The petitioner/A2 shall be released On bail on his executing personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned I Additional District and Sessions Judge-Gum-Special Judge for Trial of Offences under NDPS Act, Rajamahendravaram. ii) on release, the petitioner shall appear before the Station House officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the Charge Sheet. 7.
