PUBLIC PROSECUTOR The Court made the following 2 ORDER: This criminal petition has been filed, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to enlarge the petitioner- accused No. 2 on bail in crime No. 139 of 2025 of Visakhapatnam Police Station, G.R.P. Vijayawada, registered for the offence punishable under Section 20 (b) (ii) (B) read with Section 8 (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985, on the allegation of the petitioner- accused No. 2 had indulged in dealing with 2 K.Gs.of Ganja. 2. Heard learned counsel for the petitioner-accused No. 2 and learned Assistant Public Prosecutor appearing for the respondent-State. 3. The petitioner was arrested on 14-09-2025 based on the confession of accused No. 1. Accused No. 1 was found in possessionof 2 K.Gs. of Ganja on 12-04-2025. It is not a commercial quantity. The petitioner has been in judicial custody for the past 33 days. So far, six witnesses are examined. They are all material witnesses and official witnesses. The scope for the petitioner to threaten those witnesses may not arise. He is permanent resident of Munigud, Odisha State. He has got fixed abode. Material portion of investigation insofar as the alleged role of the petitioner is concerned is substantially completed. 4. Considering the facts and circumstances of the case and the nature and gravity of allegations levelled against the petitioner-accused No. 2, this Court is inclined to enlarge him on bail with the following stringent conditions: 3 (i) The petitioner-accused No. 2 shall be enlarged on bail subject to his executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for the like sum each to the satisfaction of learned VI Additional Judicial Magistrate of I Class for Railways – cum – VI Additional Civil Judge, Visakhapatnam; (ii) The petitioner-accused No. 2 shall appear before the Station House Officer concerned on every Saturday in between 10:00 am and 05:00 pm till filing of charge sheet; (iii) The petitioner-accused No. 2 shall make himself available for investigation as and when required; (iv) The petitioner-accused No. 2 shall not cause any threat, inducement or promise to the prosecution witnesses; (v) The petitioner-accused No. 2 shall surrender his passport, if any, to the investigating officer. If he claims that he does not have passport, he shall submit an affidavit to that effect to the Investigating Officer; and (vi) The petitioner-accused No. 2 shall not leave the limits of State of Andhra Pradesh without the express permission from the Station House Officer concerned. 5.
