1. This is the Second bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No.128/2025 registered at Police Station – Telibandha, District – Raipur (C.G.) for the offence punishable under Sections 305(A), 331(4), 3(5) of BNS, 2023.

Case of the prosecution, in brief, is that the complainant has lodged a report to the concerned police station alleging that on the date of incident, the unknown persons have entered in his shop by breaking lock and committed theft of copper pipe, kore wire and cash amount of Rs.60,000/- from his shop and on the basis of said complaint, an FIR has been lodged.
4. None appeared nor any representation is made on behalf of the applicant.

On the other hand, learned State counsel opposes the prayer for grant of bail and submits that the present applicant is a habitual offender having six prior criminal antecedents registered against him. He further submits that in the present case, the applicant along with others, committed theft from the complainant’s shop by breaking the lock and stealing copper pipes, core wires and cash amounting to Rs.60,000/- , as such, he is not entitled for grant of bail.
6. I have heard learned counsel for the parties and perused the case diary.
7. Considering the facts and circumstances of the case, allegation levelled against the present applicant, submissions made by
learned counsel for the parties, applicant is having six criminal antecedents and first bail application of the applicant was rejected by this Court vide order dated 02.07.2025 passed in MCRC No. 2707/2025. further it appears that no new ground has been taken by the applicant for his second regular bail, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.

8. Accordingly, this second bail application of applicant – Gurumendra Kulhariya involved in Crime No. 128/2025 registered at Police Station – Telibandha, District – Raipur (C.G.) for the offence punishable under Sections 305(A), 331(4), 3(5) of BNS, 2023, is rejected at this stage.
9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
