This is the second bail application filed u/s 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.02/2025 registered at Police Station City Kotwali, District Raigarh (CG) for the offence punishable under Sections 109, 103(1), 3(5) of BNS, 2023. 2. 3. As per the prosecution case, Dilip Kumar Agrawal is the proprietor of Sky King Courier and had rented out a room of his house to the delivery boys Sachin Pradhan and Sushil Bhoi. On the night of 01/01/2025 at around 11:40 PM, Sachin Pradhan informed Dilip Kumar Agrawal on his mobile phone that while consuming liquor, a dispute arose between him, Sushil Bhoi and Kunal Chhadimali and during altercation, Sushil Bhoi struck Kunal Chhadimali on the head with a vegetable-cutting knife. Upon receiving this information, Dilip Kumar Agrawal rushed to the scene. Deepak Chhadimali, uncle of the injured, also arrived at the location with his nephew Ravind. When they reached the spot, they found the room locked from the inside and Sachin Pradhan was standing outside the room, while Sushil Bhoi was inside. They called out and got the door of the room opened and saw Kunal Chhadimali lying on the floor unconscious and smeared with blood. Kunal was taken to the hospital and during treatment he died. Based on above, offense has been registered against the applicant
4. Learned counsel appearing for the applicant submits that there is no independent eye witness to the incident and the case of the prosecution is based on the circumstantial evidence. He submits that witnesses PW-5 to PW-9 who have been examined before the trial Court have not supported the case of prosecution and Dr.
Srijan Rai (PW-10) who medically examined the injured has also stated that the injuries were lacerated wound. He further submits that there are total 26 witnesses out of which 10 witnesses have been examined till date, the applicant is in jail since 02.01.2025 and there is no likelihood of the trial to be concluded at the earliest, therefore, considering all these facts, the applicant may be released on bail. 3

Learned State counsel, on the other hand, opposing the bail application submits that the applicant was inside the room where Kunal Chhadimali was lying on the floor in an unconscious state, therefore, considering the nature of offence, the applicant does not deserve to be released on bail. 6. Heard learned counsel for the parties and perused the case diary. 7. Taking into consideration the entire facts and circumstances of the case, particularly the nature and gravity of offence and the material collected and available on record against the applicant, this Court is not inclined to release the applicant on bail. 8. Accordingly, the second bail application stands rejected. 9. However, considering the fact that the applicant is in jail since 02.01.2025 and out of total 26 witnesses only 10 witnesses have been examined so far, the Trial Court is directed to expedite the trial and to ensure that the trial is concluded as early as possible preferably within a period of 4 months from the date of receipt of a copy of this order. 10.
