Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the Respondents in withholding the payment of net balance amount Rs.6,85,920/- vide CFMS number 2019-283836, even after finalizing the bills, payable to the petitioner in relation to the works i.e., Desilting of Gornagu vanka near Dorapalle (V), Dhone (M), Kurnool District, Vide Agreement No.2173 /2018-19, dated 05.01.2019 is questioned, as the same is illegal, arbitrary and consequently direct the respondents to consider for payment of amounts of Rs.6,85,920/- vide CFMS number 2019-283836 with interest @24 percent per annum for the delayed amount to the petitioner in respect of execution of above-mentioned work forthwith and pass IA NO: 1 OF 2022 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to consider for payment of amount of Rs.6,85,920/- vide CFMS number 2019-283836 with interest @24% per annum for the delayed amount to the petitioner in respect of execution of works i.e. Desilting of Gornagu vanka near Dorapalle (V), Dhone (M), Kurnool District, Vide Agreement No.2173 /2018-19, dated 05.01.2019, forthwith, pending disposal of the Writ Petition and pass Counsel for the Petitioner:

The Court made the following Order:
The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-
“…to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the Respondents in withholding the payment of net balance amount Rs.6,85,920/- vide CFMS number 2019-283836, even after finalizing the bills, payable to the petitioner in relation to the works i.e., Desilting of Gornagu vanka near Dorapalle (V), Dhone (M), Kurnool District, Vide Agreement No.2173/2018-19, dated 05.01.2019 is questioned, as the same is illegal, arbitrary and consequently direct the respondents to consider for payment of amounts of Rs.6,85,920/- vide CFMS number 2019-283836 with interest @ 24% per annum for the delayed amount to the petitioner in respect of execution of above-mentioned work forthwith and pass such other or further orders…”
2. When the writ petition came up for admission on 11.04.2022, this Court was pleased to pass the following interim direction in I.A.No.1 of 2022:
“In the circumstances, the respondents are directed to pay the approved and final bill amount due to the petitioner within a period of six (6) weeks from the date of receipt of a copy of this order.”
3. Today, when the writ petition came up for hearing, Ms. M Sumalatha, learned counsel, representing Mr. Bathala Ramesh, learned counsel for the petitioner, has stated that pending writ petition, the respondent authorities have paid the amounts due to the petitioner. 4. Recording the same, this Writ Petition is closed. There shall be no order as to costs.
