CASE HAVING COME UP FOR ADMISSION ON 18.03.2025, THE COURT ON THE SAME DAY PASSED THE FOLLOWING: 2025:KER:29596 CRL.MC NO. 2669 OF 2025 3 ORDER Petitioner is the 4th accused in SC.No.741 of 2020 pending on the files of the Special Court for SC/ST (POA) Act Cases, Thrissur The case originated from Crime No.889 of 2020 registered at the Vatanappally Police Station for offences punishable under Sections 143, 147, 148, 341, 294(b), 506 and 149 of IPC and Sections 3(1)(s) and 3(2)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. 2. Learned counsel for the petitioner submits that petitioner’s failure to appear before the court after enlargement on bail, had resulted in issuance of non-bailable warrant against him. It is submitted that the petitioner is desirous of surrendering in court, but is apprehensive that his bail application will not be considered on the day of surrender. 3. I heard the learned Public Prosecutor also. Considering the limited relief sought, the Crl. M.C. is disposed of with the following directions; i) The petitioner shall surrender before the trial court 2025:KER:29596 CRL.MC NO. 2669 OF 2025 4 and move an application for bail, with advance notice to the Public Prosecutor and the de facto complainant, within four weeks. ii) If petitioner surrenders within the time granted, orders on his bail application shall be passed on the day of surrender itself. iii) Execution of the warrant pending against the petitioner shall be kept in abeyance for four weeks.
