Order 01/12/2025
1. The instant third bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 791/2025 registered at Police Station Muhana, District Jaipur City (South) for the offences under Section 303(2) of BNS.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the offences alleged against the accused- petitioner are exclusively triable by Magistrate. It is also contended that the first bail application of the accused-petitioner was dismissed with the liberty to file afresh after filing of the charge-sheet and charge-sheet has already been filed. The learned Trial Court vide order dated 14.11.2025, dismissed the
[2025:RJ-JP:48615] (2 of 3) [CRLMB-15257/2025] bail application of the petitioner solely on the grounds that the petitioner is having criminal antecedents. It is also contended that the alleged theft was committed on 30.07.2025, however, the recovery of stolen diesel was made from the joint information furnished by the petitioner and other co-accused after four days from the date of incident from an open land. The accused- petitioner is in custody since 04.08.2025 and the trial of the case may take considerable time, therefore, the third bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the third bail application and contended that the petitioner is a habitual offender and against him 19 cases have been registered under various offences including theft, robbery, excise Act etc., therefore, the third bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the petitioner and looking to the fact that the offences alleged against the accused-petitioner are exclusively triable by Magistrate, the accused-petitioner is in custody since 04.08.2025 and the trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the third bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Ramlal @ Kachchha S/o Shri Rodu, in connection with FIR No. 791/2025 registered at Police Station Muhana, District Jaipur City (South), shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/-
