THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.34401 of 2025
ORDER: The present writ petition is filed questioning the orders dated 25.09.2025 passed by the 4th respondent.
2. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue appearing for the respondents.
3. The grievance of the petitioners is that the respondents have not followed the directions issued by this Court in Sudalagunta Sugars Ltd., v. The Joint Collector, Chittoor1, wherein this Court has mandated issuance of Forms-I and II notices to both assignee as well as purchaser. In the instant case, the respondents have issued only Form-I notice to the petitioners/purchasers. Further, the learned counsel has also made his submissions that the subject lands are not assigned lands and they are patta lands and the petitioners are bona fide purchasers.

In reply to the said contentions, learned Assistant Government Pleader appearing on behalf of the respondents, on instructions, has submitted that the subject lands are assigned lands and in all these lands the assignees have violated the conditions of the assignment. Accordingly, the authority has initiated proceedings under the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977 (for short 8the Act9) and passed orders after issuing notices under Forms-I and II to the assignees and purchasers and she has not clear whether the respondents have strictly followed the mandate given by this Court in the above referred judgment or not?

Considering the submissions and also on perusal of the impugned orders, it shows that there is no clarity with regard to the issuance of Forms-I and II notices to both the assignees as well as the purchasers. As contended by learned counsel for the petitioners the respondents have issued only Form-I notice to the petitioners/purchasers.
6. Considering the submissions made by learned counsel for the petitioners as well as learned Assistant Government Pleader, the impugned orders dated 25.09.2025 passed by the 4th

respondent are set aside remanding the matter to the original authority to initiate fresh action by strictly following the provisions of the Act and also the mandate given by this Court in the above referred judgment and pass appropriate orders in accordance with law.
7. Accordingly, the Writ Petition is allowed. There shall be no
order as to costs. As a sequel, miscellaneous petitions, pending if any, shall stand closed. _______________________ JUSTICE D.RAMESH
