APARESH KUMAR SINGH Order 12/02/2025 Heard Mr. Debesh Chandra Roy, learned counsel for the petitioner and Mr. Raju Datta, learned Public Prosecutor for the respondent-State. Petitioner has once again approached this Court under Section 482 of the Cr.P.C as the further investigation in respect of Agartala PS. Case No. 293/2018 have not been completed despite order dated 20.12.2022 passed by this Court in Crl. Petn. No.59/2022. Earlier the police had submitted final form showing the case to be on mistake of fact. On protest by the informant- petitioner, the learned trial Court vide order dated 01.10.2020 directed further investigation. Since investigations were not being concluded in time, petitioner had approached this Court in Crl. Petn. No.59/2022. However, despite a specific order passed in the said case, investigation has not been completed till now. Therefore, petitioner has once again approached this Court under Section 482 of Cr.P.C. Mr. Raju Datta, learned Public Prosecutor has on written instructions submitted that the investigating officer has submitted a final report (civil in nature) in the instant case before the learned Court of Chief Judicial Magistrate, West Tripura, Agartala. It is submitted that therefore, this Court may not be required to pass any further orders in this regard. Learned counsel for the petitioner submits that liberty may be granted to the petitioner to raise an objection, if so advised, to the latest final form submitted by the agency. Accordingly, liberty is granted to do so. As such, the instant petition is disposed of. Pending application(s), if any, also stands disposed of.
