The applicant has filed this application to transfer the divorce proceeding filed by the non- applicant before the Family Court at Aurangabad to Family Court at Amravati. 2. Learned counsel for the applicant has stated that the applicant is staying at Amravati along with her parents. When the matter was settled between the parties, they started residing together. The non-applicant restrained her from going before the Family Court at Aurangabad. He beat her and thrown away her sim card from her mobile phone, therefore, she had lodged complaint against the non- applicant. It is dangerous for her to attend the Family Court at Aurangabad. She cannot stay with Prity 2 / 2 41.mca323.2023 non-applicant at Aurangabad and there is no place for her to stay there even for short period to attend the Court. As the Aurangabad is 400 kms away from Amravati, hence, has prayed to transfer the matter from Family Court at Aurangabad to Family Court at Amravati. 3. Though, the non-applicant is served, it appears from office note that he refused to accept the notice. 4. Heard learned counsel for the applicant. 5. During the settlement period the non- applicant restrained the applicant to attend the Family Court at Aurangabad, hence, she had lodged complaint against non-applicant. Considering the allegations about assault to restrain her from attending the Court. It will not proper to compel her to attend the Family Court at Aurangabad. 6. As such, the miscellaneous civil application is allowed. The petition bearing No.A284/2022 pending before the Family Court at Aurangabad is transferred to the file of Family Court at Amravati.
