2. Petitioner has been made accused in connection with Sahibganj (Mufassil) P.S. Case No. 45 of 2022 for the offences registered under sections 147, 148, 149, 341, 323, 324, 325, 326, 307, 302, 504 and 506 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Sahibganj.
3. On 10.04.2022 petitioner along with co-accused persons had assaulted the Informant, due to which, several persons sustained injuries and father of the Informant namely, Nurul Hoda succumbed to his injuries.

Learned counsel appearing on behalf of the petitioner submitted that there is general allegation against the petitioner. It was further submitted that similarly situated co-accused persons Md. Kamal, Md. Saddam, Md. Alam and Md. Motiur Rahman have been granted bail by different coordinate Benches of this Court.
5. Mr. Sudarshan Singh, learned counsel appearing on behalf of the Informant has vehemently opposed the prayer for bail and submitted that bail application of some of the co-accused persons have been rejected by this court as well as by the coordinate Bench of this Court.
6. It appears that anticipatory bail application of co-accused Md. Laltu and Md. Malekustur has been rejected by this court as they were present at the spot and had opened fire to deter any person from interfering with the main assailant while the deceased was being assaulted.

7. Considering the fact that there is no specific allegation against the petitioner, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Sahibganj in connection with Sahibganj (Mufassil) P.S. Case No. 45 of 2022.
