Bhagwati Devi Respondent :- State Of Uttar Pradesh And 2 Others Counsel for Petitioner :- Shesh Mani Pandey,Shri Ram Pandey Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Vinod Diwakar,J. 1. Heard learned counsel for the petitioner, the learned Additional Chief Standing Counsel for the State-respondents, and perused the material available on record. 2. The present writ petition has been filed seeking issuance of a writ, order, or direction in the nature of mandamus, commanding respondent nos. 2 and 3 to include the petitioner's name in the list of beneficiaries prepared on 07.06.2024 and published in the newspaper on 20.06.2024, and to allot 7% residential land to the petitioner against the land acquired by the said respondents. 3. During the course of arguments, learned counsel for the petitioner confined the relief to a limited prayer for a direction to the competent authority to consider and decide a fresh representation to be submitted by the petitioner. 4. Considering the facts and circumstances of the case, this Court is of the opinion that no useful purpose would be served in keeping the writ petition pending. Accordingly, with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to submit a fresh representation before the competent authority, clearly stating all her grievances. 5. In the event such a representation is submitted within two weeks from today, the competent authority shall consider and decide the same on its own merits and in accordance with law, after affording an opportunity of hearing to all concerned parties. The decision shall be taken expeditiously, preferably within a period of two months from the date of submission of the representation. Order Date :- 7.7.2025 Anil K.
