1. This is Second Bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita 2023 for grant of regular bail to applicant, who has been arrested in connection with Crime No.428/2024, registered at PS -Chakarbhatha, District Bilaspur C.G., for commission of offence punishable under Section 376(2)(N) of IPC and Sections 4 & 6 of the POCSO Act.

2. Case of prosecution, in brief, is that the applicant has committed forceful sexual intercourse with minor victim on many occasion, due to which, she became six months pregnant. Based upon report, FIR was registered and applicant has been arrested in the alleged offence/crime.
3. Learned counsel for applicant submits that this second bail application is filed in change circumstances, there is a considerable delay in trial, therefore, the applicant may be enlarged on bail.
4. Learned State Counsel opposes submission of learned counsel for applicant and would submit that there is no pleading of any new grounds but all the grounds are on merits.
5. Heard learned counsel for parties and perused the bail application.
6. Pursuant to order of this Court, Aunt (Bua) of victim appeared before this Court and raised objection in granting bail to applicant.
7. Perusal of grounds does not reflect that any new ground has been pleaded in application, hence, I do not find any change in circumstances to entertain this second bail application.
8. Accordingly, second bail application is hereby rejected/dismissed. However, looking to the detention period of the applicant, ie, since 03.10.2024, trial Court concerned is directed to conclude the trial expeditiously, as soon as possible, if there is no any legal impediment.
