Judgment / Order 04/12/2025
1. Instant Writ Petition is preferred by writ petitioner with following prayer:- (i) Issue an appropriate writ order or direction in the nature thereof thereby dismissing the order no. CHO(DV)/2025/235A dated 01.12.2025 by the Respondents and by the time no adverse action to be taken against the selection process of the petitioner for the post of Contractual Community Health Officer.
[2025:RJ-JP:49244] (2 of 3) [CW-18993/2025] ii) Issue an appropriate writ order or direction in the nature thereof thereby, Direct the Respondents to provisionally accept the Petitioner's candidature and allow her to participate in the entire selection process including the written examination and document verification for the post of Contractual Community Health Officer (CHO) and if petitioner find place in merit then consider her for appointment.
2. The short controversy in the writ petition is that the school name of the petitioner is Baby Kumari Meena whereas after marriage she has changed her name to Baby Masar and only due to confusion created on account of change in her name (Surname) the candidature of petitioner was not considered by respondent(s).
3.
Learned counsel for petitioner while placing reliance upon
order dated 22.11.2024 issued by one of the respondent with regard to CHO Recruitment, 2022 submits that in earlier recruitment the verification was conducted in the same name as certificate relating to educational qualification clearly spells the name as “Baby Kumari Meena” whereas after marriage the petitioner is known as “Baby Masar”.
4.
Learned counsel appearing on behalf of respondent submits that petitioner may submit a representation to the respondent and respondents shall examine representation after due inquiry and if it finds that the “Baby Masar” and “Baby Kumari Meena” are same then they will consider the candidature of present petitioner.
5. Considered the grievance raised herein, the petitioner is given a liberty to submit a representation to respondent within a period of four weeks from now raising all grounds. The respondents are directed to consider and decide the representation after due inquiry, but in case of deviation with a reasoned and speaking order within a period of 4 weeks from date of receipt of representation. After passing the order, the
[2025:RJ-JP:49244] (3 of 3) [CW-18993/2025] respondents are under an obligation to communicate the order to the petitioner either by way of speed post or through E-mail, if petitioner has provided E-mail in her representation. If the petitioner is still aggrieved, she has right to re-approach the court with fresh petition.
6. Accordingly, the writ petition with pending application, if any, stands disposed.
