For Petitioner : Mr.M.Elumalai Page No.1 of 5 https://www.mhc.tn.gov.in/judis W.P.No.14169 of 2025 For Respondents 1 to 3 : Mr.S.J.Mohamed Sathik, Government Advocate O R D E R The petitioner has filed this petition to direct the second respondent to pass final orders in the application submitted by the petitioner dated 02.08.2024 under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, pursuant to the summons issued to the fourth respondent in Na.Ka.A3/133/2024 dated 21.08.2024 for the enquiry on 30.08.2024. 2. The petitioner, a senior citizen, executed a Settlement Deed dated 04.07.2023 in favour of her daughter (the fourth respondent) based on false assurances that she would be taken care of in her old age. However, the fourth respondent failed to do so and instead neglected the petitioner. The petitioner, therefore, approached the second respondent under The Maintenance and Welfare of Parents and Senior Citizens Act seeking cancellation of the Settlement Deed. Despite the second respondent issuing summons for an enquiry on 30.08.2024, no further action was taken. On the same date, the fourth respondent allegedly quarreled with the petitioner, damaged her mobile phone, and took it away. A complaint was lodged with the second respondent, but no steps were taken. Aggrieved by the inaction, the petitioner has filed the Page No.2 of 5 https://www.mhc.tn.gov.in/judis W.P.No.14169 of 2025 present writ petition. 3. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice if this Court issues direction to the second respondent to consider the petitioner's representation dated 02.08.2024 on merits and in accordance with law, within a time frame to be fixed by this Court. 4. Learned Government Advocate appearing for the second respondent submitted that the second respondent has initiated the enquiry proceeding and fixed the date of enquiry on 30.08.2024. 5. Heard the learned counsel on either side and perused the materials available on record. 6. Considering the submission made by the learned counsel on either side, this Court directs the second respondent to complete the enquiry and pass appropriate orders on merits and in accordance with law, within a period of two months from the date of receipt of a copy of this order.
