No. 418-1 belongs to the 1st petitioner, an extent of Ac. 1.03 cents in Sy. No. 418-1 belongs to the 2nd petitioner and an extent of Ac. 2.38 cents in Sy. No. 418-2 belongs to the 3rd petitioner situated in Kota Village, K. Gangavaram Mandal, East Godavari District pending disposal of the above writ petition in the interest of justice Counsel for the Petitioner(S): 1. GP FOR LAND ACQUISITION The Court made the following Order: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This Writ Petition was filed declaring the Preliminary Notification, issued by the 2nd respondent vide Ref. G4/497/2019 dated 05.03.2020 under section 11(1) of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013 (Act 30 of 2013) whereby proposed to acquire the agricultural lands of the petitioners i.e. an extent of Ac.1.80 cents in Sy.No.418-1 belongs to the 1st petitioner, an extent of Ac.1.03 cents in Sy.No.418-1 belongs to the 2nd petitioner and an extent of Ac.2.38 cents in Sy.No.418-2 belongs to the 3rd petitioner situated in Kota Village, K. Gangavaram Mandal, East Godavari District without determining Social Impact and Public purpose as required under Chapter II of the Act 30 of 2013 3 HBKM,J W.P.No.8226 of 2020 and contrary to section 10 of the Act 30 of 2013 and all consequential proceedings. 3. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 4th respondent dated 20.02.2025 submits that an Alternative land was identified in Sy Nos.89-2 and 91-1 measuring an extent of Ac 4.03cts of land in Kota village and acquired private land under Voluntary land acquisition for providing house sites to the beneficiaries of Kota village. There is no need of acquiring the subject lands Ac 6.0050cts in Sy.Nos.418-1, 418-2 and 416-1 of Kota Village. 4. In view of the above said facts and circumstances and upon consideration ofZ the written instructions of the 4th respondent, dated 20.02.2025, no further orders are necessary in this matter as no cause survives. 5. Accordingly, this Writ Petition is dismissed as infructuous. Interim order if any deemed to have been vacated. There shall be no order as to costs. The written instructions of the 4th respondent dated 20.02.2025 shall be made as part of the Court record.
