JUSTICE V.SRISHANANDA) 1. Heard Sri.Sanket S. Amboli, learned counsel for the petitioner and Smt.Girija S. Hiremath, learned High Court Government Pleader for respondent-State. 2. Petitioner in Crl.P.No.101408/2025 is accused No.5 seeking anticipatory bail. Whereas petitioner in Crl.P.No.101445/2025 is accused No.6 seeking regular bail. 3. Facts in brief which are utmost necessary for the disposal for present petitions are as under: A complaint came to be lodged by Smt.Laxmibai W/o Arjun @ Sakrappa Meerajkar, neighbour of the accused persons with Guledagudda Police on 20.02.2025 which was registered in Crime No.22/2025 for the offences punishable under Sections 109, 115(2), 118(2), 189(2), 190, 191(2), 351(2), 352 and 74 of the Bharatiya Nyaya Sanhita, 2023 (for short, ‘the BNS’). In respect of the same incident wife - 4 - NC: 2025:KHC-D:5956 CRL.P No. 101408 of 2025 C/W CRL.P No. 101445 of 2025 of Monohar has also lodged a complaint against the complainant and others. 4. The incident has occurred on account of construction of the staircase. Taking note of the fact that accused No.5 is not available and accused No.6 is in custody for a period of more than 45 days and also taking note of the injuries sustained by the injured persons, this Court is of the considered opinion that both the bail petitions needs to be allowed as there is sufficient progress in the investigation both in this case and counter case. 5. Apprehensions of the prosecution can be met with by imposing suitable and stringent conditions. 6. Accordingly, the following orders are passed. ORDER Crl.P.No.101408/2025 i. The criminal petition is allowed. ii. Petitioner is directed to join the investigation by appearing before the Investigation Officer on 17.04.2025 at 9.00 a.m. positively. - 5 - NC: 2025:KHC-D:5956 CRL.P No. 101408 of 2025 C/W CRL.P No. 101445 of 2025 iii. The Investigating Officer is at liberty to take the petitioner to custody and complete the custodial investigation if any, on the same day before 5.00 p.m. Thereafter, petitioner is directed to be enlarged on bail, by taking a bond in a sum of Rs.50,000/- with one surety for the likesum. iv. The petitioner shall co-operate with the Investigating Agency in all aspects of the matter. v. Petitioner shall attend the Court regularly. vi. Petitioner shall mark their attendance before the Investigating Officer on every alternate Sunday between 10.00 am and 2.00 pm., till the final report is filed. vii. Petitioner shall not leave the jurisdiction of Bagalkot District without prior permission. ORDER Crl.P.No.101445/2025 i. The criminal petition is allowed. ii. The Petitioner shall be enlarged on bail on executing a personal bond in a sum of Rs.50,000/- with one surety for the likesum to the satisfaction of the learned Trial Judge. iii. The petitioner shall not directly or indirectly tamper the prosecution evidence or hamper the investigation process in any manner. iv. Petitioner shall not leave the jurisdiction of Bagalkot District without prior permission. v. Petitioner shall attend the court regularly. vi.
