1. The petitioner has filed the present writ petition, being aggrieved by the inaction on the part of the respondent-Corporation in failing to take any steps to demolish the illegal and unauthorized construction allegedly carried out at premises no. 85/H/23, Narkeldanga North Road, P.S. Narkeldanga, Kolkata, at the instance of the private respondent.
2. The petitioner further contends that he had lodged a complaint dated 11.10.2023, but no action was taken pursuant thereto.
3.
Learned Counsel for the respondent submits that, pursuant to the complaint dated 11.10.2023, a demolition case has already been initiated against the unauthorized construction, and a demolition order was passed on 29.09.2023. It is further submitted
2 that demolition action will be taken expeditiously in compliance with the said order dated 29.09.2023.
4. The State is directed to provide adequate police assistance, if required, to the respondent-Corporation for carrying out the demolition.
5. A copy of the demolition
order dated 29.09.2023 has been handed over to the learned Counsel for the petitioner.
6. In view of the above, nothing survives for adjudication in the present writ petition, since the grievance of the petitioner has already been addressed, and the Corporation has acted upon his complaint dated 11.10.2023 by initiating proceedings and passing the demolition order.
7. Accordingly, the present writ petition is
disposed of.
8. Since no affidavits have been filed by the respondents, the allegations made in the writ petition shall not be deemed to have been admitted.
10. There shall be no order as to costs.
11. Let urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
