Order on Board 26/11/2025 This writ petition has been filed by the petitioner claiming following reliefs :
2 (1) That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to produce all the relevant records relating to case of the petitioner before this Hon'ble Court for its kind perusal. (ii) That this Hon'ble Court may kindly be pleased to quash the impugned charge sheet dated 04.12.2015 (Annexure P/1) issued to the petitioner by respondent No.4/Superintendent of Police, Distt. Bijapur (CG). (iii) That this Hon'ble Court may also kindly be pleased to quash the impugned show cause notice dated 15.2.2017 (Annexure P/7) issued to the petitioner by respondent No.4/Superintendent of Police, Distt. Bijapur (CG). (iv) That this Hon'ble Court may kindly be pleased to quash the whole departmental enquiry proceedings conducted against the petitioner. (v) That this Hon'ble Court may further be pleased to direct respondents to give suitable compensation to the petitioner for the mental trauma and agony, harassment and hardships suffered by him.

Learned counsel for the petitioner submits that the departmental enquiry was initiated against the petitioner and the other delinquent employee namely Susheel Tripathi in violation of Rule 18 of CCA Rule 1966. Therefore, this writ petition was filed challenging the departmental enquiry and this Court vide its order dated 08.05.2017 stayed the further proceedings of the departmental enquiry initiated against the petitioner.

During the course of submission, State counsel submitted that the departmental enquiry against the petitioner had came to a logical conclusion and the petitioner was imposed with the punishment of stoppage of one increment with cumulative effect, against which, appeals were also filed. As the punishment and appellate order are not under challenge, the relief as claimed cannot be granted.
4. In light of the above submission, counsel for the petitioner seeks to withdraw this petition with liberty to file duly constituted petition challenging the punishment and appellate order. The documents submitted by Mr. Shandangi is made part of the record.
5. Accordingly, this writ petition is disposed of with the aforesaid liberty. Sd/-
