HARPREET SINGH BRAR J. (Oral) Prayer in this petition is for issuance of direction to learned trial Court to dispose of the complaint i.e. COMA 716 of 2015 (Annexure P-2), titled as Usav Build India Private Limited vs Manoj Kumar Gupta, pending in the Court of learned Judicial Magistrate Ist Class, Sonepat, Haryana.
Learned counsel for the petitioner, inter alia, contends that the complaint (supra) was filed on 19.08.2015, under Sections 138 read with Section 141/142 of the Negotiable Instruments Act, 1881. The petitioner has closed its evidence on 17.03.2022. Further the statement of the accused/respondent No.2 was recorded on 09.05.2022 and respondent No.2 had taken more than 25 opportunities, however, the defence has failed to produce its evidence. Moreover, it is a 10 years old case and the private respondent is delaying the conclusion of the trial on one pretext or the other.

CRM-M-22617-2025 (O&M) I have heard learned counsel for the parties and perused the record of the case. On 29.04.2025, this Court has sought the report of learned trial Court through District & Sessions Judge, Sonepat, which has been received. A perusal of the report indicates that learned Judicial Magistrate Ist Class, Sonepat, is making best efforts to conclude the trial. In view of the report of the learned trial Court, the present petition is disposed of and the learned trial Court is directed to conclude the trial expeditiously preferably within a period of four months from today.
