Coram : Hon’ble Mr. Justice N.S.Shekhawat Present : Mr. T.P.S. Bawa, Advocate (Legal Aid Counsel) for the petitioner. Mr. Gurmeet Singh, AAG, Haryana. *** N.S.Shekhawat J. (Oral)
1. The petitioner has filed the instant petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant regular bail to him in case FIR No.33 dated 27.02.2023 registered under Sections 323, 34, 506 of IPC (subsequently added Sections 325, 307 of IPC), at Police Station Dhand, District Kaithal.
2.
Learned counsel for the petitioner contends that the alleged occurrence had taken place on 23.02.2023, whereas the FIR (Annexure P-1) was registered after a delay of 04 days on 27.02.2023 and this time was utilized by the prosecution in coining a false version. He further contends that it has been falsely alleged that the petitioner had caused injuries with knife to Balwan Singh, complainant, however, the Medico Legal Report (MLR) of Balwan Singh demolishes the entire prosecution case. Learned counsel further contends that the petitioner was arrested in the present case on 03.07.2023 and till date, the prosecution has been able to examine only 02 witnesses, out of total 13 HEMLATA 2025.04.28 23:12 I attest to the accuracy and integrity of this document

3. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner, however, he admits that the injured has already been discharged from the hospital and the petitioner is not facing any other prosecution.
4. I have heard the learned counsel for the parties and perused the record.
5. The petitioner is stated to be in custody for the last about 01 year and 10 months. Even, the petitioner is the first offender and was never involved in any other criminal activity. Moreover, only two witnesses, out of total 13 witnesses, have been examined so far. Thus, the conclusion of the trial may take quite a long time and further custody of the petitioner will not serve any meaningful purpose.
6. Without commenting on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate, concerned.
