GP FOR HOME (AP) The Court made the following: 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.10858 OF 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….to pass an order or direction or any other proceedings one in the nature of Writ of Mandamus declaring the action of the respondents 3 and 4 in interfering with civil disputes pending the Appeal Suit A.S.No.41 of 2019 on the file of Hon'ble District Judge, Anantapuramu and threatening the petitioner to vacate the land to an extent of Ac. 2.02 cents in Sy.No.216/2B of Somaladoddi Village of Anantapuramu Rural Mandal of Anantapuramu District as illegal, arbitrary and without jurisdiction and violation of the petitioners rights guarantee under Article 14,19(g),21 and 300A of the Constitution of India and consequently direct the respondents not to interfere with the petitioner's peaceful possession of the property to an extent of Ac. 2.02 cents in Sy.No. 216/2B of Somaladoddi Village of Anantapuramu Rural Mandal of Anantapuramu District, and to pass…” 2. Sri Harish Kumar Rasineni, learned counsel for the petitioner appeared through video conference. 3. Learned Assistant Government Pleader for Home on written instructions would submit that a report was received from the 6th respondent against the writ petitioner, police concluded preliminary enquiry, and found that both parties disputing regarding title of a land and appeal is pending before the Court. Therefore, as the matter is civil in nature, they did not register any case in this regard on the reports. Further, police did not interfere in the matter, as the matter is civil in nature. 4. Considering the submissions made by learned Assistant Government Pleader for Home that the matter is civil in nature, police 4 will not interfere in the matter, this Court is of the considered opinion that the writ petition can be closed at the stage of admission, without going into the merits of the case. 5. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
