Present applicant is seeking regular bail in relation to FIR dated 12.03.2025 bearing FIR No. 06 of 2025 Police Station – Mukteshwar, District – Nainital wherein present applicant has been implicated for the offences punishable under Sections 8 / 20 NDPS Act. 4. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated and the contraband (Charas), which is shown to be recovered from the applicant, is below commercial quantity and there is no proper compliance of Section 50 and 57 of the NDPS Act and applicant has no previous criminal history. 5. On the other side, learned AGA for the State fairly submits that applicant has no previous criminal history and the contraband, which is shown to be recovered from the applicant, is below commercial. 6. After hearing learned counsel for the parties and further taking into consideration that applicant has no previous criminal history and the contraband, which is shown to be recovered from the applicant is below commercial quantity, this Court is of the view that applicant deserves for bail. Accordingly, without expressing any opinion on the merit of the case, bail application is allowed. 7. Let the applicant – Mohan Singh be released on bail on furnishing a personal bond and two sureties, each of the like amount to the satisfaction of court concerned.
