On the request of the learned counsel for the Petitioner, he is permitted to withdraw the present CMP application with liberty to file a revision petition under Section 115 of the CPC before the jurisdictional Court, Bhubaneswar. The present CMP application is being disposed of with a liberty as prayed for. Further liberty is granted to the Petitioner to file an application with a prayer for condonation of delay if any in preferring the revision application. 4. In such eventuality, learned revisional court shall consider such application taking a lenient view that the Petitioner had approached this Court by filing the present CMP application under a wrong impression.
