BY ITS PANCHAYAT SECRETARY ...RESPONDENT(S): 2 Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased tomay be pleased to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the respondents No. 2 to 8 herein in trying to lay the CC Road and Drain in the petitioner's land situated in Sy No. 159-10 to an extent of Ac 0.14 cents of Chilakapalem Revenue Village, Allinagaram Gram Panchayat, Etcherla Mandal, Srikakulam District without initiating the proceedings under The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act No. 30 of 2013) is not legal and the same is violative of Article 300-A of the Constitution of India, and without following the due process of law as illegal, arbitrary, against the principles of natural justice and consequently direct the respondents not to dispossess the petitioner from the possession and enjoyment of the land situated in Sy No. 159- 10 to an extent of Ac 0.14 cents of Chilakapalem Revenue Village, Allinagaram Gram Panchayat, Etcherla Mandal, Srikakulam District for laying of the CC Road and Drain and pass such IA NO: 1 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to stay of all further proceedings including laying of the road in the petitioner's land situated in Sy No. 159-10 to an extent of Ac 0.14 cents of Chilakapalem Revenue Village, Allinagaram Gram Panchayat, Etcherla Mandal, Srikakulam District, pending disposal of the writ petition. GP FOR PANCHAYAT RAJ RURAL DEV 3 The Court made the following Order: Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for the respondent Nos.1 to 5 & 7 and the learned Assistant Government Pleader for the 8th respondent. 2. This writ petition was filed questioning the action of the respondent Nos.2 to 8 in trying to lay the CC road and drain in the petitioner’s land situated in Sy.No.159-10 to an extent of Ac.0.14 cents of Chilakapalem Revenue Village, Allinagaram Gram Panchayat, Etcherla Mandal, Srikakulam District without initiating the proceedings under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. 3. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 7th respondent dated 14.10.2025 submits that the said proposal of laying the road was withdrawn and the revenue authorities are not proceeding further to lay a road on the subject land. 4. In view of the above said instructions of the 7th respondent and the submissions of the learned Assistant Government Pleader, no further orders are necessary in this writ petition, as no cause survives. 5. Accordingly, the writ petition is dismissed as infructuous. The written instructions of the 7th respondent dated 14.10.2025 shall be 4 made as part of the court record. Interim order if any, deemed to have been vacated. There shall be no order as to costs.
