THE HON’BLE SRI JUSTICE HARINATH.N WRIT PETITION No.28531 OF 2025 ORDER
1. The petitioner is aggrieved by the action of the 2nd respondent in attempting to alter the nature of the land admeasuring 17 cents situated in CAS No.573/6 at Ram Nagar Colony, Nellore Bit No.1, Nellore. 2. The learned counsel for the petitioner submits that the land of the petitioner’s mother admeasuring 5 cents was taken over by the 2nd respondent for mini bypass road formation in the year 1992 with an assurance that an alternate site would be provided in lieu of compensation. It is submitted that the respondent authorities have proposed to allot 17 cents of land in Sy.No.CAS 573/6 to the petitioner, for which the petitioner is required to pay an amount of Rs.2,55,55,200/-. The petitioner is willing to deposit the said amount, subject to the respondent authorities executing the requisite documents. It is further submitted that the 2nd respondent is now attempting to alter the nature of the land rendering the proposal to execute the title deeds in favour of the petitioner for the alternate land. The proposals are pending with the government for approval, and once the same are approved, the petitioner is willing to deposit the amount called for. -3- W.P. The learned standing counsel for the 2nd respondent submits that the 2nd respondent had inspected the site during routine outdoor site inspection on 08.09.2025 as part of periodic measures for the protection of Government land. It is also stated in the written instructions that there is no interference with the subject land and any such interference shall be in accordance with due process of law. 4.
Recording the submissions, the writ petition is disposed of with a direction to the 2nd respondent not to alter the nature of the subject land, which is proposed to be offered to the petitioner as an exchange for the land acquired from the petitioner’s mother, without following the due process of law. No costs. 5. Pending miscellaneous petitions, if any, shall stand closed. ___________________ JUSTICE HARINATH.N BV
