Counsel for Petitioner :- Akhilesh Srivastava,Indu Bhushan Tripathi,Krishna Mohan Asthana Counsel for Respondent :- Amrish Sahai,Ashok Trivedi Hon'ble Saurabh Shyam Shamshery,J. 1. Heard Sri K.M. Asthana, learned counsel for petitioners and Sri Ashok Trivedi as well as Sri Amrish Sahai, Advocates for respondents. 2. In the present bunch of five writ petitions there are in total 13 petitioners. 3. This Court has passed an order dated 21.02.2018 in order to verify allegations of impersonation by petitioners in an examination conducted by Respondent-2 for different banks by referring the thumb impressions to NCRB. 4. In pursuance of above order, fresh thumb impressions given by petitioners were compared with the thumb impressions given in written examination, interview and pre-joining. As per report of NCRB thumb impressions of 8 petitioners, namely, Paras Nath Srivastava, Sunil Kumar, Arvind Kumar Nimesh, Rahul Singh, Ravi Kumar, Km. Rashmi, Om Prakash Singh and Aneesh Kumar were verified and it is the stand of learned counsel appearing for Respondent-Bank that they have been given appointment and so far remaining four petitioners, Narendra Kumar, Ghamandi Lal, Manish Kumar and Amit Kumar are concerned, their thumb impressions were not verified since they were blurred. 5. It appears that thumb impression of petitioner-Sagar Singh in Writ-A No. 2055 of 2017 was not sent for examination in pursuance of above referred order of this Court. 6. In view of above, now the question left is with regard to five petitioners, namely, Narendra Kumar, Ghamandi Lal, Manish Kumar, Amit Kumar and Sagar Singh. 7. Learned counsel appearing for Respondent-Bank has placed on record an order dated 18.04.2023 passed by a Coordinate Bench of this Court in Pramod Kumar vs. Chief Manager H.R.M. Baroda U.P. Gramin Bank and another (Writ-A No. 51830 of 2016), which appears to be in similar circumstances, that in such cases an opportunity be granted that such petitioners to give fresh thumb impressions so that it may be forwarded to NCRB for verification. Learned counsel fairly submits that in the present writ petitions same direction be passed so far as above referred five petitioners are concerned. 8. Learned counsel appearing for petitioners submits that he has no objection to above submission made by learned counsel for Respondent-Bank. 9. In view of above, the writ petitions are disposed of with observations that petitioners-Narendra Kumar, Ghamandi Lal, Manish Kumar, Amit Kumar and Sagar Singh will appear before Head Office of Bank, i.e., 2nd and 3rd Floor, Block A, NBCC Commercial Complex Vardan Khand, Gomti Nagar Extension, Lucknow on 27th May, 2025 between 10 to 11 AM. Fresh thumb impressions shall be taken in presence of Additional District Magistrate, Lucknow. It will be duty of Respondent-Bank to communicate this order to Additional District Magistrate, Lucknow so that said Officer shall remain present on 27th May, 2025 and he will verify the identity of petitioners by their identity card. Thereafter specimen of thumb impressions shall be put under sealed cover alongwith other documents and it will be sent to NCRB and its outcome shall be communicated to petitioners. 10. The petitioners, whose thumb impressions are verified, they will be given appointment and so far rest of petitioners are concerned, the Respondent-Bank will be at liberty to lodge First Information Report.
