THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 4072 of 2021 ORDER:
1. This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a writ of Mandamus or any other appropriate writ, order or direction declaring the impugned action of the respondent No.3 at the active instance of the respondents 4 and 5 in threatening the petitioner to foist false criminal cases in case if he proceed with the construction of a house building in his own vacant site ie., 226 sq. yards in R.S.No.294/1 situated in Penugonda (v), West Godavari District and calling him to the police station and abusing the petitioner in fowl language as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents 2 and 3 not to interfere with the civil rights of the petitioner.”
2. Heard Sri P.Srinivasa Rao, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for respondents. 3. Learned Assistant Government Pleader for Home for respondents would submit that in the light of the interim orders passed by this Court, the police are not interfering with the construction activity being taken up by the petitioner and not interfering in the civil dispute and further submits that no crime has been registered against the petitioner. 4.
Recording the same, the writ petition is disposed of. However, police are directed not to interfere in the civil dispute, except under due process of law. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. ________________________________________
