IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH 257 CRM-M-25754-2022 (O&M) Date of decision: 17.09.2025 Ravinder Kumar ...Petitioner(s) VERSUS State of Haryana ...Respondent(s) CORAM : HON'BLE MR. JUSTICE VINOD S. BHARDWAJ Present :- Mr. Rajesh Garg, Sr. Advocate with Ms. Neha Matharoo, Advocate; Mr. Rajinder Goyal, Advocate for the petitioner. Dr. (Ms.) Malvika Singh, DAG Haryana. ***** VINOD S. BHARDWAJ, J. (Oral) 1. The present petition has been filed for quashing of FIR bearing No.171 dated 26.04.2022 under Sections 167, 182, 195-A, 198, 211, 218 and 120-B of the Indian Penal Code, 1860 registered at Police Station Sector-5, Panchkula alongwith all subsequent proceedings arising therefrom. 2. Learned State counsel, on instructions from ASI Kuldeep, informs this Court that the sanction to prosecute the offence had been declined by the State Government, hence, the proceedings in the FIR cannot continue any further. She contends that the appropriate report in this regard could not be furnished on account of order dated 06.07.2022 passed by this Court restraining the investigating agency from filing any final report in the matter. 3. Learned senior counsel appearing on behalf of the petitioner MANGAL SINGH 2025.09.19 14:02 I am the author of this document 2 257 CRM-M-25754-2022 (O&M) contends that the dispute being raised before this Court pertains to the very foundation and competence of the respondent-authority to register the FIR. Taking into consideration that the sanction to investigate the offence has been declined by the respondent, I find that the said issues are not required to be gone into at this juncture, since the said exercise would only be academic. Hence, keeping the questions open, the present petition is disposed of as having been rendered infructuous. 4. All pending misc. application(s), if any, stand disposed of. (VINOD S. BHARDWAJ) 17.09.2025 JUDGE Mangal Singh Whether speaking/reasoned : Yes/No Whether reportable : Yes/No MANGAL SINGH 2025.09.19 14:02 I am the author of this document
