Sri Sanjay Kumar Yadav, learned counsel for CBI and Sri Ajay Singh learned counsel for the State are present and have been heard and perused the records. 4. The present appeal has been preferred against the judgment and order dated 18.11.2008 passed by Special Judge, (Anti Corruption) Meerut in S.T. No. 29 of 1996 thereby convicting and sentencing the Appellant 2 years rigorous imprisonment with the fine of Rs. 5,000/- and in default of payment of fine 2 months additional simple imprisonment under Section 7 of the Anti Corruption Act, 1998 and 2 years rigorous imprisonment with the fine of Rs. 5,000/- and in default of payment of fine 2 months under section 13(1)D read with Section 13(2) Anti Corruption Act, 1988. 5. Even previously on 19.07.2023, no one appeared on behalf of the appellant and non-bailable warrants were issued against the appellant. As per the office report dated 29.11.2023, a report of C.J.M., Agra dated 29.08.2023 has been received stating therein that the sole appellant Onkar Singh has died. The said report has been sent after due inquiry. 6. This Court has perused the said report which states that the accused-appellant has died. 7. In view of the above, the appeal stands abated. 8. The trial court records, if received, be sent back along with the communication of this order. Office to communicate this order 9.
