The petitioners are claiming rehabilitation and resettlement in terms of rehabilitation and resettlement policy of NTPC, 2017 and the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, as they were dispossessed from their land holdings in pursuance of the acquisition of the same for the benefit of NTPC. The case of the petitioners is that they received a notice from the office of S.D.M. Robertsganj, Sonbhadra on 04.05.2024 fixing 09.05.2024 for considering their claim for rehabilitation and resettlement. The petitioners appeared before the said Authority on the specified time and date and also submitted their claims and evidence but so far no decision has been taken in the matter and hence the instant petition. 2. Sri Rajiv Gupta, learned counsel appearing on behalf of the State respondents states that in case no decision has been taken in the matter, the concerned authority will take decision within eight weeks. 3. Accordingly, the writ petition is disposed of by providing that decision in pursuance of notice dated 04.05.2024 issued by the office of S.D.M. Robertsganj, Sonbhadra shall be taken by the concerned Authority within eight weeks from the date of communication of the instant order along with photocopy of the notice dated 04.05.2024. 4. In case any decision has already been taken, the same shall be communicated to the petitioners within two weeks from the date of communication of the order. (Anish Kumar Gupta, J.)
