The bail application of the applicant was rejected by the Additional District and Sessions Judge No.2, Jaipur Metropolitan-I, Jaipur vide order dated 15.10.2025, thereafter, the applicant has preferred this bail application under Section 483 B.N.S.S.
2.
Learned counsel for the applicant submits that the other person named in the impugned FIR namely Chetan Sharma S/o
[2025:RJ-JP:51301] (2 of 3) [CRLMB-13908/2025] Bhanwar Lal has already been enlarged on bail by the co-ordinate Bench of this Court in S.B. Criminal Misc. Bail Application No.5503/2025 vide order dated 22.07.2025. Learned counsel further submits that the co-ordinate Bench of this Court decided the bail application of the other co-accused persons namely Rakesh Kumar Saini and Rishabh Sharma in S.B. Criminal Misc. Bail Application No.5972/2025 vide order dated 25.08.2025, by which, their bail applications were dismissed by a common order as mentioned above. Learned counsel submits that out of three persons one person namely Rishabh Sharma has approached the Hon’ble Supreme Court by way of filing SLP (CRL.) No.15694/2025 later on converted to Criminal Appeal No.5114/2025 titled as Rishabh Sharma Vs. State of Rajasthan, in which, the Hon’ble Supreme Court has granted bail to the co-accused Rishabh Sharma by order dated 28.11.2025. In view of the above fact that the other co-accused have been enlarged on bail by the Hon’ble Supreme Court, the allegations levelled against him in the impugned FIR are triable by the Magistrate, he prayed that the present accused-applicant may be enlarged on bail. 3. Learned Public Prosecutor strongly opposed the bail application on the ground that there are three cases pending against the accused-applicant including the present case in respect of the same property registered at the same police station. In view of the above fact, he prayed that the accused- applicant may not be enlarged on bail. 4. This Court considered the fact that one single plot mentioned in the three FIRs and further on the basis of the same FIR, other persons have already been enlarged on bail as mentioned above. [2025:RJ-JP:51301] (3 of 3) [CRLMB-13908/2025] Further one person namely Rishabh Sharma has been enlarged on bail by the Hon’ble Supreme Court, therefore parity is required to be maintained. 6. Considering the overall facts and circumstances of the case and maintaining parity, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-applicant on bail. 7.
Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-applicant - Vinay Kumar Jangid S/o Shri Prahlad Kumar shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The applicant is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case. (RAVI CHIRANIA),J Monika/66
