JUSTICE DR. ANSHUMAN ORAL ORDER 2 23-06-2025 Learned counsel for the petitioners, learned counsel for the State and learned counsel for the Accountant General are present. 2. The present writ petition has been filed for the following reliefs:- I. For direction upon the respondent authorities to implement the judgment/order dated 26.04.2024 passed in LPA No.-458/2021 (arising out of CWJC No.-1744/2020) by the Division Bench of this Hon'ble Court in respect of the petitioners of the present writ application Patna High Court CWJC No.9534 of 2025(2) dt.23-06-2025 6/8 also as they are similarly situated to the appellants/petitioners of LPA No.-458/2021 and extend them all consequential benefits i.e. refund of recovered amounts, if any and restore the pay-fixation in the light of the facts that the petitioners were/are entitled to 1st ACP in the scale of Rs.4000-6000/- which was already allowed to them by the respondents. II. To hold that petitioners are covered by the judgment/order dated 26.04.2024 passed by the Division Bench of this Hon'ble Court in LPA No.-458/2021 and therefore, as per Clause-4.C (1) of the Bihar Litigation Policy, 2011 issued under resolution dated 31.03.2011 by the State Govt. they are also entitled to be given the same and similar benefits as has been given to the appellants/petitioners of LPA No.- 458/2021 and any discrimination with the petitioners would amount to violation/breach of the Bihar Litigation Policy, 2011 by the respondent authorities. III. For any other relief/reliefs to which the petitioners are entitled to in the facts and circumstances of this case. 3. Learned counsel for the petitioners submits that the representation of some of the petitioners has been annexed as Annexure-P/13 series, but the same has not been considered. Patna High Court CWJC No.9534 of 2025(2) dt.23-06-2025 7/8 Counsel further submits that the petitioners have sought relief in light of the decision rendered by the Hon’ble Division Bench of this Hon’ble Court dated 26.04.2024, passed in L.P.A. No. 458 of 2021 (arising out of CWJC No. 1744 of 2020), and they are squarely covered by the said decision. Counsel also submits that one of the reliefs is being sought in light of Clause 4.C of the Bihar State Litigation Policy, 2011, issued under resolution dated 31.03.2011 by the State Government. 4. Learned counsel for the State submits that the representation of all the petitioners has not been filed. Counsel further submits that a direction may be issued to all the petitioners to file a fresh representation before the appropriate authority, clearly indicating the grounds raised in the present writ petition. 5. In this view of the matter, it is here directed to the petitioners to file a fresh representation before the Director General of Police, Bihar, Patna, Patel Bhawan, Bailey Road, Patna (Respondent No. 2) within 30 days raising all points which they have raised in the present writ petition along with the order passed by this Hon’ble Court and Respondent No. 2 is directed to pass a reasoned and speaking order on the Patna High Court CWJC No.9534 of 2025(2) dt.23-06-2025 8/8 petitioners’ representation within 90 days thereafter with liberty granted to Respondent No. 2 to pass individual order or collective order, as he thinks appropriate. 6.
