This is the First bail application 7led under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail to the applicant who has been arrested in connection with Crime No. 450/2025 registered at Police Station– Bodhghat District- Bastar (C.G.), for the o;ence punishable under Section 21(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
2. Case of the prosecution, in brief, is that the Police of Police Station – Bodhghat District- Bastar, (C.G.), had received secret information RAHUL DEWANGAN Digitally signed by RAHUL DEWANGAN
2 from the informant and on the basis of the said information conducted a raid and seized contraband article i.e. Becalm 0.5 alprazolam tablet I.P.0.5 mg 90 strip Containing 15 tablets each total 1350 tablets/Drugs ( total tablets weight 0.100 x 1350= 135 gram) from the joint possession of the present applicant and co- accused person. Thereafter, the Police has registered the o;ence punishable under Section 21(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 against the present applicant.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case and there is no material to show that he had committed or participated in the alleged o;ence. It is submitted that the applicant has been in custody since 13.10.2025, and being the sole earning member of his family, his continued detention is causing severe hardship to his dependents. The applicant has no criminal antecedents of a similar nature. It is further urged that the two so-called independent witnesses, Rajesh Yadav and Roshan Jha, before whom the alleged proceedings were conducted, are stock witnesses of Bodhghat Police Station who frequently depose in NDPS and Excise matters, rendering the proceedings highly doubtful. The FIR itself vaguely states that the applicant and another person were jointly arrested with narcotic tablets, yet it does not specify from whose possession the alleged contraband was actually recovered. He also submits that no narcotic substance was recovered from the applicant, nor was he found in conscious possession of any such article, and the entire case appears to be a result of police manipulation, in which the
3 applicant has been falsely framed. Hence, he prays for grant of regular bail to the present applicant. 4. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that the quantity of contraband article i.e. Becalm 0.5 alprazolam tablet I.P.0.5 mg 90 strip Containing 15 tablets each total 1350 tablets/Drugs (total tablets weight 0.100 x 1350= 135 gram) from the joint possession of the present applicant along with co-accused person, which is much above the commercial quantity, as such, the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and further the fact that the contraband article i.e. Becalm 0.5 alprazolam tablet I.P.0.5 mg 90 strip Containing 15 tablets each total 1350 tablets/Drugs (total tablets weight 0.100 x 1350= 135 gram) from the joint possession of the present applicant along with co-accused person, is much above the commercial quantity and the applicant has failed to give any explanation for the same, further it cannot be a case of false implication. 7.
Accordingly, the bail application of the applicant – Girja Shankar Sethiya, involved in Crime No. 450/2025 registered at Police Station– Bodhghat District- Bastar (C.G.), for the o;ence punishable under Section 21(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 4
8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. OEce is directed to send a certi7ed copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
