No. DATE ORDER OFFICE NOTE 7. 22.01.2026 CGR,J I.A.No.1 of 2025 (On being mentioned) The present application is filed under the caption 8for being mentioned9, inter alia stating that this Court by final order dated 23.09.2025, allowed the claim granting compensation, however has not provided for Apportionment of claim amount so awarded amongst the claimants who are the wife and four (04) major children of the deceased. Hence, it necessitated for filing the present application. Heard learned counsel appellants and learned counsel for the respondents. A perusal of the final order dated 23.09.2025, indicates that there is no such apportionment factor in the operative portion of the order. Considering the submissions made by the learned counsel for the applicants as well as the learned counsel for the respondents who does not oppose the application, the 2 same stands ordered. Having considered the order dated 23.09.2025, Para-17 of the final Order/Judgment shall stand substituted as under:- <17. Accordingly, the impugned order passed by the Tribunal is hereby set aside and the Appeal stands allowed by allowing the claim of compensation. The appellants are entitled for compensation to the tune of Rs.4,00,000/- along with interest at the rate of 7% from the date of filing of the claim application till its realisation. It is made clear that after applying the rate of interest, if the final figure is less than Rs.8,00,000, then the appellants shall be entitled to Rs.8,00,000/-, Aforesaid amount of compensation is directed to be paid by the respondent Railways within a period of eight weeks from the date of receipt of a copy of this judgment. As against the amount so awarded, the first appellant shall be entitled to withdraw amount of Rs.4,00,000/- and the appellant Nos.2 to 5 are entitled to withdraw an amount of Rs.1,00,000/- each.= Cont& 3 The Registry is directed to issue the order after incorporating the above changes.
