ORDER: The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C), has been filed by the Petitioners/Accused Nos.2, 3 and 6, seeking quashment of the proceedings pending against them in C.C.No.3258 of 2021 on the file of the Special Judicial Magistrate of First Class, Prohibition and Excise Cases, Guntur for the offences punishable under Sections 498-A, 323, 509 IPC and under Sections 3 and 4 of the Dowry Prohibition Act.

learned counsel for the Petitioners/AccusedNos.2, 3 and 6 and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.
Learned counsel for the petitioners would submit that there specific allegations made against the petitioners/Accused Nos.2, 3 and 6 and further this Court vide order dated 24.12.2024, passed in Crl.P.No.2951 of 2022 has considered the case of the Accused Nos.4 and 5, who are arrayed as the co-accused along with the petitioners herein in C.C.No.3258 of 2021, on the file of the Special Judicial Magistrate of First Class, Prohibition and Excise Cases, Guntur.
Learned counsel would further submit that the petitioners herein were also on the same footing and it is fit case for quashment of C.C.No.3258 of 2021, pending before the Special Judicial Magistrate of First Class, Prohibition and Excise Cases, Guntur. 3. are no
Per contra learned counsel appearing for the respondent No.2 would
4. submit that there are clear allegations that are made against the Accused No.2 in the present crime and the complaint itself would show that the Accused No.2 had demanded the money from the respondent No.2 and also received Rs.20,00,000/-. Learned counsel would further submit that the case of the Accused No.2 is not on similar footing as the case of the Accused Nos.4 and

As such, in the light of the specific allegations made against the accused No.2, it is not a fit case for quashment of C.C.No.3258 of 2021, on the file of the Special Judicial Magistrate of First Class, Prohibition and Excise Cases, Guntur with regard to the Accused No.2 is concerned. Learned Assistant Public Prosecutor appearing for the State would
5. submit that the Court may pass appropriate orders. Considering the submissions made and a fair look at the material placed on record, which shows that this Court vide its order dated 24.12.2024, passed in Crl.P.No.2951 of 2022, has considered the case of the Accused
6. Nos.4 and 5, wherein the Accused No.4 is the sister of the Accused No.1 and the Accused No.5 is the husband of the Accused No.4. Whereas, in the present petition, the Accused No.3 is the brother of the Accused No.1 and the Accused No.6 is the wife of the Accused No.3. As rightly put by the learned counsel for the petitioners, there are no specific allegations made against the petitioners herein. In that view, as there is a specific allegation attributed against the

Accused No.2 with regard to the demanding of money from the respondent No.2, this Court feels it appropriate to partly allow the Criminal Petition to the extent of the petitioners/accused Nos.3 and 6 are concerned and dismiss the criminal petition with regard to the accused No.2. In the result, the Criminal Petition is partly allowed to the extent of
8. petitioners/accused Nos.3 and 6 are concerned and so far as the accused No.2 is concerned, the criminal petition is dismissed. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
